The Hong Kong Securities and Futures Commission (SFC) has issued a strict warning to virtual asset trading platforms (VATPs) regarding their licensing framework. On February 5, 2024, the SFC published a report, urging crypto investors to verify the regulatory status of VATPs.
Hong Kong SFC warning to VATPs
However, this report follows a prior warning, and the deadline for obtaining a license or submitting an application is coming closer to an end. According to the SFC, investors must check whether their virtual asset trading platforms are listed on the “List of licensed virtual asset trading platforms” or the “List of virtual asset trading platform applicants.”
For your information, if VATPs are listed in the “List of licensed virtual asset trading platforms,” crypto users can use their platform as they are licensed by the SFC. If VATPs are on the “List of virtual asset trading platform applicants,” it indicates that the VATPs have submitted their application to the Hong Kong SFC. However, according to the SFC, VATPs must submit their applications before or on February 29, 2024.
Additionally, the SFC has urged investors to check the regulatory status of these VATPs from time to time and, in any event, on March 1, 2024. This is because if any VATPs operating in Hong Kong discover that they do not have a license and have not submitted their applications to the SFC by February 29, 2024, the SFC mandates that they cease their operation in Hong Kong by May 31, 2024.
In addition, the SFC has also urged investors and crypto users to shift their VATPs if they are not on the “List of licensed virtual asset trading platforms” or the “List of virtual asset trading platform applicants.” The statement emphasized making preparations early, before May 31, 2024, such as closing accounts with these VATPs or transferring to SFC-licensed VATPs for trading virtual assets.
Why SFC is urging VATPs for licensing framework?
All these measures are being taken to control money laundering and other illicit activities in this rapidly evolving cryptocurrency landscape. Meanwhile, the Hong Kong SFC has been warning these unlicensed firms to apply for a crypto VATP license since August 2023, as reported by Todayq News. During that time, they also asserted that engaging in unlicensed crypto activities constitutes a criminal offense within the city.
This significant step by the Hong Kong SFC indicates its aim to bolster its status as a global financial hub.
